National Panhellenic Council Constitution and Bylaws

ARTICLE I: NAME.

1. The name of this organization shall be the University of Tennessee at Martin National Pan-Hellenic Council.

2. The organization shall be a "chartered" student organization of the University.

ARTICLE II: PURPOSE.

The purpose of this organization is:

A. To provide the governing body for all Black Greek organizations and any group affiliated with Black Greek Organizations.

B. To promote cultural programs, workshops, etc. for the advancement of the community in civic, economic, educational and political affairs;

C. To supplement and endorse the efforts of civic and social groups for the betterment of race relations;

D. To work in conjunction with the Black Student Association, administrative officers and other organizations in all matters affecting the welfare of the student body, especially minority students.

E. To aide in the social adjustment and maturation of minority students;and

F. To develop the leadership capabilities of the members.

G. To promote unity among Greek organizations on campus regardless of race, religion or Greek affiliation.

ARTICLE III: MEMBERSHIP.

Section 1

A. The Pan-Hellenic Council shall consist of currently enrolled undergraduate students who are active members of the fraternity/sorority system.

B. Each organization shall have at least one representative for business meetings and voting.

C. Each organization shall have a specific alternate who shall have the same privileges as the delegates. In case of changing the appointed delegate for an organization, a seven (7) day notice should be submitted in writing to the council along with the name of hte new delegate.

D. Organizations not represented at each of the council meetings and not making an effort to officially notify someone that cannot be represented shall be fined $30 per meeting missed.

E. Each organization shall present a monthly calendar of events followed by discussion to avoid overlapping of activities with discussion.

F. Each organization for the Pan-Hellenic Council can not reap the benifits or privileges of the Council if the organization holds dual membership with another Greek council.

G. Each organization activie inthe NPHC shall pay yearly dues of $100, payable during the first week of the spring semester.

Section 2

A. Quorum shall be two-thirds (2/3) of the active organizations under the Pan-Hellenic Council.

Section 3

A. Parliamentary authority for this organization shall be found in the Pan-Hellenic by-laws.

ARTICLE IV: OFFICERS

Section 1

The elected officers of the Pan-Hellenic Council shall be the President, Vice President, Secretary and Treasurer.

Section 2

The officers shall be elected for a term of one (1) year with the term of office to coincide with the Greek Awards Banquet.

Section 3

A. If the office of President becomes vacant, the Vice- President shall fill it on an interim basis until a special election may be called. At the time of that special election, the Vice- President be declared a candidate for the chair.

B. In the event the office of President and Vice Presidrent should become vacant simultaneously, for any reason, the delegates shall appoint the Secretary to the position of interim President with two-thirds (2/3) approval of hte representatives present.

C. The delegates shall nominate and vote with two-thirds (2/3) approval of the representatives present.

Section 4

The President for the Pan-Hellenic Council shall have the following duties and powers:

A. To preside over and organize all meetings of the Council.

B. To insure that a consensus is reached on all decisions effecting NPHC affiliates.

C. To call special meetings when appropriate.

D. To represent the Pan-HEllenic Council at any meeting with University Administrators and be the official representative of the Pan-Hellenic Council to the external community.

E. To insure that the Pan-Hellenic Council operates in accordance with the Constitution and Handbook of the National Pan-Hellenic Council, Incorporated.

Section 5

The Secretary of the National Pan-Hellenic Council shall have the following duties and powers:

A. Serve as the taker of minutes at all meetings of the Council.

B. Shall be the chief record keeping officer for the Council.

Section 6

The Treasurer of the Naional Pan-Hellnic Council shall have the following duties and powers:

A. Create a budget and disperse checks as needed for the Council

E. Assist the Chair in all aspects of Council management.

ARTICLE V. ELECTIONS AND QUALIFICATIONS FOR HOLDING OFFICE.

Section 1. Eligibility.

Candidates for office must meet the following requirements:

1. Upperclassmen (specifically juniors/seniors)

2. Full-Time enrolled undergraduate students at UT-Martin for the designated term.

3. Must be financially and scholastically active within your chapter OR at a minimum, have a 2.00 cumulative grade point average.

4. For the chair position, one year of involvement on the NPHC Council level.

Failure to meet any of these standards may result in removal or disqualification.

Section 2. Procedures

1. Elections shall take place each year during the end of the Fall semester for a term to begin/end in coordination with the Greek Awards Banquet.

2. Nominations will be taken one week prior to the set election date for all offices.

3. No one organization shall hold more than one office on the NPHC executive board.

4. The "Election" meeting shall be an "All_Greek Meeting". All candidates for both offices shall be permitted a set time to speak on their goals for NPHC.

5. If a position goes apposed, there shall be a debate of candidates for president and vice president with vice- President candidates going first.

6. Each chapter shall break off and discuss the candidates. Chapters, by secret ballot, will then cast seven (7) votes for the candidates. These votes may be broken up how the chapter sees fit amongst the candidates.

7. There will be a run-off in each category until a candidate recieves 50% +1 of the votes cast.

ARTICLE VI: MEETINGS.

The UTM NPHC shall have formal meetings on the following schedules:

During Fall semester: Monday at 6:00pm in the Student Life Center

*The first meeting shall be set at the end of the proceeding spring

*Meetings will be held once a week through the fall semester.

During Spring semester:

*Pending necessary business, meetings during the spring shall be once every weeks.

New business requiring decisions of the whole shall be automatically tabled until the next subsequent meeting to allow for time to take the information back to chapters for discussion.

ARTICLE VII: AFFILIATION.

In order to fulfill it's purpose; this organization shall be affiliated with the National Pan-Hellenic Council, Inc.

ARTICLE VIII: AMENDMENTS.

Section 1.

All amendments to this constitution may be proposed by the delegates, the council officers, or by petition bearing 5% of the financially active greek members.

Section 2.

A. Proposed amendments to the constitution may be amended at regular meeting of the Council provided 2/3 of the Council delegates present vote in favor of said proposed amendment.

B. Proposed amendments must be presented to teh Council of Delegates one month (1) prior to being discussed. The only exception shall be immediately entering/exiting summer break.

C. Proposals must be typed, double spaced, dated and signed.

Section 3.

Upon adoption, amendments shall be inserted in the place in this constitution that they change, and the portions amended shall be deleted. Those amednemetns that are added shall be placed in additional sections in the articles to which they pertain.

Section 4.

The UTM NPHC shall be entitled to maintain its own set of bylaws. While the bylaws may not contradict or serve as official amendments of this constitution, they shall serve to supplement the constitution and aid in the administration of the NPHC.

NPHC CONSTITUTIONAL BYLAWS

Section 1.

Robert's Rules of Order shall govern all business meetings except upon a passed motion to suspend the rules.

Section 2.

All voting organizations must be financially active (meaning all bills clear with the Council) in order to have a vote in council meetings.

Section 3.

Any executive or delegate who has two (2) unexcused absences shall come before the UTM NPHC for re-instatement. If a third unexcused absence results, the affected member shall be replaced.

Section 4.

In order to recieve any of the money garnered through ticket sales at the Annual Homecoming Greek Show organizations must do one of the following: 1) Be active with the NPHC meaning but not limited to regular attendees, active in NPHC activities, actively pursuing ways through the Council to improve the NPHC community, 2) be actual contestants in the step show, or 3) be an active participant in the planning/management of the step show.

Section 5.

The UTM NPHC shall build a better communications network between other NPHC organizations in the state and nationally. In order to do this, the UTM NPHC shall encourage all organizations covered under this constitutions and said orgaizations affiliated with said NPHC organizations to participate in all functions of the UTM NPHC. THis organization shall not discriminate against any other greek orgaization operating on campus regardless of race, religion, or greek affiliation.

Section 6.

All NPHC affiliated organizations shall be required to maintain a 2.0 semester average in accordance with the UTM Student Handbook. NPHC reserves the right to take action in assisting/sanctioning chapters who fail to hold these academic standards.

Section 7.

Spring fraternity and sorority week times shall be selected in the Fall semester. The selecting order shall be determined based on the final semester averages from the previous spring semester grade report.

 

 

 

BYLAWS GOVERNING JUDICAL BOARD

Section 1: Purpose

A. The NPHC Judical Board shall enforce the National Pan Hellenic Council Constitution and Bylaws

Section 2: Jurisdiction

A. The jurisdiction of the NPHC Judicil Board shall encompass all violations of the above stated policies or documents and shall be held intact unless superseded by a higher governing body or university official.

B. The NPHC Judicial Board reserves the right to hold a chapter accountable for the actions of an indivdual member or members if not turned over to the Judicial Board.

C. The NPHC Judicial Board shall have the power to impose sanctions, as it deems necessary and appropriate.

D. The NPHC reserves the right to bring any sanctions and hearing related information to the attention of the Coodinator of Student Activities and Greek Life and the Student Conduct Officer.

Section 3: Membership and Officers

A. Voting Members

1. The voting members of the NPHC Judicial Board shall consist of the Chief Justice and one (1) NPHC officer from each member chapter of the NPHC. If a Chapter is not holding a office, that chapter shall submit a member to serve on the board.

2. Each Member chapter is allowed one (1)- voting member to the NPHC Judicial Board.

3. Each voting member shall have one (1) vote during all hearings, except when the case heard pertains to his chapter.

4. Attendance of either the President or Vice- President of the chapter under the alleged violation is required at all hearings.

5. The NPHC President will serve as the justice in the event that the chief justice is a member of the accused chapter.

 

B. Chief Justice shall have the following qualification:

1. member of NPHC organization for a minimum of one (1) year.

2. Shall have a minimum of a two point five (2.5) Grade point average

3. Must be in good displinary standing with the university.

4. Shall not be president of any other NPHC organization.

5. The chief justice shall not be of the same greek letter organization as the president of NPHC.

C. Advisor

1. The advisor to the NPHC shall serve as an advisor to the NPHC Judicial Borard.

2. The advisor shall oversee and assist the chief justice in the implementation of the notification of the hearing system and the completion of all hearing related documentation.

D. Participation in these hearing shall be only voting member and those officers described herein, along with any witnesses who are asking to be present. However, if an attendance question arises not addressed in this document, all hearings shall be compliant with open meeting laws.

 

Section 4: Filing of Complaint

A. Compliant must be filed through an official compliant form, which may be obtained in the Office of Student Life.

B. Only student or employees of UTM may file official compliant forms.

C. Official compliants must be submitted to the NPHC Advisor no later than ten (10) school days after the alleged violation took place.

 

Section 5: Notification of Hearing System

A. The NPHC Advisor shall notify the president of the accused chapter that his/her chapter is under investigation as soon as an official written compliant has been filed.

B. After the official compliant has been filed and the president of the accused chapter has been notified, a maximum of ten (10) days during which school is in session shall be allowed for the investigation to take place. The hearing must be scheduled within ten (10) days during which school is in session after the president has been notified of the official compliant (not after the alleged violation took place).

C. The Chief Justice and the NPHC Advisor shall present written notificatoin of the scheduled hearing to all partices at least 72 hours prior to the time at which the hearing will be held.

D. The written notification of a hearing must include the following information:

1. The date, time, location, and type of alleged incident

2. The specified policy and/or document allegedly violated,

3. The date, time, and location of the NPHC Judicial Board hearing

4. A review of the established NPHC Judicial Board hearing procedure as outlined in S

5. Procedure if there is a conflict with a date or time of hearing

 

Section 6: Hearing Procedure

A. There must be 100% attendance of all officers and voting members for the NPHC Judicial Board to hear a compliant and render a decision.

- If attendance is not possible, notificatoin must be made to the Chief Justice twenty-four (24) hours prior to the hearing.

B. The hearing shall proceed as follows:

1. Review of the NPHC Judicial Board purpose and jurisdiction by the chairman.

2. Reading of the officil compliant by the chairman.

3. Admission or denial of alleged violation by president of accused chapter.

4. Review of results of investigation of compliant and presentation of evidence by advisor and witnesses/ compliant if possible.

5. Presentation of testimony, statements, or documents by president of accused of investigation.

6. Posing of questions to president of accused chapter and witnesses regarding any testimony given or statement provided.

7. Posing of questions to president of accused chapter and witnesses regarding any testimony given or statement provided.

8. Final statement by president of accused chapter.

9. Dismissal of president of accused chapter by the Chief Justice.

 

Section 7: Deliberation Procedure

A. The NPHC Judicial Board shall deliberate in closed session with only voting ex-officio member present.

B. The deliberation shall proceed as follows:

1. Review the facts presented during the hearing by chairperson

2. Vote to determine whether or not the accused chapter is guilty of a violation

a. The vote shall be by secret ballot

b. A simple majority vote shall be required to render a decision

c. Absentations shall be prohibited

3. Review of estblished sanctions by chairperson

4. Discussion of possible sanctions by any voting member

5. Recommendation of specific sanctions by voting members

6. Vote to accept recommended sanctions by voting members

a. The vote shall be cast by secret ballot

b. A simple majority vote shall be requried to render a decision.

c. Absentations shall be prohibited.

7. Review and verification of established sanctions by chairperson.

8. Reminder of expectation of confidentiality of procedings by the chairperson.

 

Section 8: Notification of Hearing Results

A. The president of the accused chapter shall be notified informally of the results of the hearing immediately following the conclusion.

B. Official written notification of hearing results and sanctions shall be issued to the president of the accused chapter no later than twenty-four (24) hours following the conclusion of the hearing.

C. The official notification of hearing results must include following information:

1. The date and time of NPHC Judicial Board hearing.

2. The specific policy or document violated

3. A detailed outline of all sanctions, including date for completion

4. An explaination of the grounds and process for appeal

5. A request that question regarding the NPHC Judicial Board decision are to be directed to Judicial Officers.

6. Signatures of both Judicial Officer as well as the NPHC Judicial Board Advisor

D. Copies of the official hearing results shall be distributed to the following:

1. Voting members of the NPHC Judicial Board

2. Coordinator of Student Activities and Greek Life

3. Advisor of the accused chapter

4. Student Conduct Officer

5. President of the accused chapter

E. Copies of the Official hearing results shall be kept in the NPHC Judicial Board file as well as in the accused chapter's file in the Office of Student Life.

 

Section 9: Appeals

A. The only grounds for an appeal of the NPHC Judicial Board decisions are as follows:

1. Lack of due processes, as it is established in this document.

2. The discovery of new and substantive information pertaining to the violation, as deemed to be so by the NPHC Chief Justice.

B. All appeals of the decisions of the NPHC Judicial Board shall be directed to the NPHC President.

C. Appeals of official hearing results must be filed within five (5) days of the decision. During which school is in session following the reciept of the official notification of hearing results.

D. Appeal must be submitted in writing

 

Section 10: Failure to Comply

A. Sanction Contracts shall be prepared by the Chief Justice and shall include the following:

1. Desciption of the sanction

2. Name of the person/people supervising the sanction

3. Date when the sanction must be completed

4. Statement regarding the consequences of an uncompleted sanction

5. Signatures from the following people:

a. NPHC Judicial Officers

b. The person/people supervising the sanction

c. The President of the chapter involved

d. The Judicial Board Advisor

B. If a sanction is not completed or is violated in any way , a complaint will be flied and the accused chapter will reappear in front of the NPHC Judicial Board.

C. If multiple acts of non-compliance occur, the NPHC Judicial Board may refer the matter to the Student Conduct Officer.

D. Appeals may be made to the Coodinator of Student Activities and Greek Life, or Appeals committee.
